Our first entrant is...

Our first entrant is Cheers at 627 North Lindell Street in Martin, TN! I would be remiss if I failed to note that their Representative, Mark Maddox, and their Senator, Roy Herron (a Democratic gubernatorial candidate, no less) voted to override the Governor's veto, and I have it on reasonably good authority that they never bothered to talk to their local bar owners about this. They will regret that, I'm betting.

  1. That sign won't be considered legal according to the Tennessee code. He'll need to invest in a new sign.

  2. Out of curiosity, what is the "fullest extent of the law?" What would the charge be against a a person with a carry permit bringing a firearm onto private property against the stated wishes of the property owner?

  3. Christian - given that the sign is not posted in accordance with Tennessee state code, the worst the restaurant owner/employees can do is ask you to leave - after all, all private establishments reserve the right to refuse service to anyone. If you do not leave, you are then trespassing, and can be arrested for that.

Interestingly, though, even if they notice you carrying, your firearm will not enter the equation at all - since the sign is not a TN-government-recognized sign, the courts should not care.

  4. Okay there is the first restuarant I'll avoid on my bike trip to check out TN and GA motorcycle worthy roads. If they don't want my business I am happy to go elsewhere.

  5. I'm confused - any weapons at all? I assume they don't have knives for you to cut your food with. Forks work in a pinch too. And as a Marine, I was trained in hand to hand combat so I assume I must remove or otherwise bind my arms and legs before I enter.

I also assume that they have no glass bottles and that the chairs are bolted to the floor.

The problem with people like this is that they assume that signs are all that's needed to keep out the criminal element and / or, like the purveyors of this blog, equate the law abiding with the criminals.

To Steve, do you really think that criminals will look at this sign and not enter with weapons? Really?

  6. Are they going to enforce this against law enforcement who come in with their weapons to dine? It is illegal for them also.

  7. Wow, seriously? As if criminals will pay any attention to the hysterical NO GUNS!!! sign in the window.

Google Luby's Cafe murders and ask yourself, what if the patrons had been allowed to carry a gun for self-defense at the time of the shootings? Failing that ask yourself why the murderer felt that he could violate the Texas prohibition on carrying handguns by private citizens (since changed due in large part to this incident)?

Florida for instance allows the carrying of concealed weapons in restaurants, so far no problems. Amazingly you can actually have a beer while carrying (as long as you are not in the bar area) and still no problems.

Stop with the no guns schtick it's getting old, instead concentrate on stopping criminals from victimizing innocents.
